Auctioneer Webinar Series: New Legislation: Unsigned Rental Agreements
In an industry where ownership changes hands frequently, finding unsigned rental agreements is not uncommon. It is a major pain point for many operators that the self storage statutes have not addressed for a long time. Given the time and cost of legal eviction proceedings, many operators have chosen to risk the liability of enforcing a lien on an unsigned rental agreement. In recent years, the industry has begun addressing this issue and adding provisions to the statutes. While the changes have not yet reached all 50 states, several now have a legal remedy available to them. Those states are listed below. Auctioneer Webinar Series: Statutorily Required Rental Agreement Contents
Most storage operators know that they must send letters and run legal ads. Most probably know the timelines and contents for these actions. What many may not be aware of is the specific statutory requirements for your rental agreement.
While your self-storage rental agreements should always be reviewed and drafted by an industry-experienced attorney, it is also important for storage operators to know what your statute requires you to include in your rental agreement to meet the qualifications to process your lien. Most states have specific requirements for what you must have included in your rental agreement. These include specific verbiage passages, font and text requirements, and specific questions or disclosures.
This presentation will help you identify where to find your statute and where to look for rental agreement requirements. This session is designed to improve your overall knowledge of the statutes and help you identify possible shortcomings of your rental agreement. If you find you are not meeting these most basic requirements, it is imperative you consult with an attorney immediately.
